Does anyone know of any vendors who are Safe Harbor certified who can host a customized version of Moodle? Thanks!

You could get a server on Amazon's cloud (Web Services) - they're Safe Harbour:

Amazon is a US-based company, but they are signed up to respect the Safe Harbour agreement - which was thrashed out with the EU, so European companies could use accredited US providers safe in the knowledge the laws would be respected. Though Amazon has data centers all over the world (I think), so in theory you could be more 'local' by specifying it's hosted in a European data center.
