So I'm guessing that that code was added for a reason... someone wanted to stop the first item in a particular menu from appearing. But is was not specific enough and therefore impacted on ALL first items in ALL menus. The problem you now have is that by removing the code, the original reason for it being there will have returned. Maybe wait and see who complains before you address it - but if someone does shout loudly, it's possible to be very specific and hide what they don't people to see without impacting on all menus.
