We are seeing this behavior as well. It appears to behave correctly with the use of marking guide comments on an assignment, so I think it may need to be fixed. I didn't see a tracker issue for it, so I added one, if anyone would like to comment/vote it up: https://tracker.moodle.org/browse/MDL-72492
