Thanks for working on MDL-78994 and highlighting the issue here. If you visit moodle.org and don't log in, it does indeed take a lot of tabbing to navigate to the policy links at the bottom of the page.
Your proposed solution sounds good to me, though I'm not knowledgeable enough to comment on whether it's OK to have a disconnect between the visual order and the tab order of elements.
