Generally forums are a bad place to ask for legal advice - especially when it comes to selling services based on code copyrighted/trademarked/written by someone else.

If you plan to sell Moodle services you should look at becoming a Moodle Partner. This allows you to use the Moodle trademarks to sell services.

If you want to pass the Moodle app off as your own work and generate income from it without being a Moodle Partner - that sounds pretty dodgy and no one here can support or help you with this.

Hello Dan,

Why are "forums a bad place to ask for legal advice - especially when it comes to selling services based on code copyrighted/trademarked/written by someone else."?

What exactly is dodgy with his idea to customize and rebrand the app?

Unfortunately I do not know the answer to this question (related to the app), otherwise I would help.

Peter

When looking for legal advice you should consult a lawyer - not ask a community of people that all have very different views, are from different jurisdictions, have different interpretations and understandings of open source licences etc etc.

Moodle is also covered by trademarks which have restricted uses:

If you want to make $$ off selling Moodle services, you should investigate becoming a Moodle partner.

I still don't get your point why someone could not ask an open source license related question on moodle.org  I also doubt that no one in the community has an answer to this question.

What do you mean with  "If you want to make $$ off selling Moodle services, you should investigate becoming a Moodle partner."  and why are you saying so?

To answer your question, the Moodle app is open source under the Apache License 2.0, which does allow you to sell your own version of the app without seeking any additional permission from Moodle HQ.

However, as Dan mentions you can't use the Moodle trademark in your app without being a Moodle partner, so you'd have to remove all Moodle branding.  I'd follow his advice and consult a lawyer who specialises in copyright and trademark law before going any further.
